Unalterable records FAQs

Either parent can obtain copies of their Unalterable Records anytime on their own. Records can be obtained in PDF or printed format. PDF Records can be easily emailed to attorneys, courts, law enforcement, or anyone else. We keep all complete Records as an independent third party so both users have access to the exact same Records at all times.
Our users can obtain a copy of any Record anytime in PDF format. They can also purchase a printed copy of any Record. When a user purchases a Printed Record from us, they also receive the master PDF file with its corresponding Digital Signature and unique 16-digit Authentication Code. Users can purchase an optional signed and notarized affidavit when purchasing a Printed Record. They can also print their Record from the PDF file on their own. PDF Records are easy to search electronically, and it may not be necessary to print the entire Record or purchase a Printed Record from us to utilize the relevant parts of the Record as evidence in court.
All TalkingParents Records are generated by our system in PDF format. When a user purchases a Printed Record, they will also receive the master PDF file. A unique 16-digit code is assigned to every Record our system generates. We permanently archive the original file so that any TalkingParents Record can be authenticated as genuine and accurate if necessary. The unique Authentication Code is located at the bottom of every page of the Record. A Printed Record, whether ordered from us or printed from the PDF file by the user or someone else, can be tied back to the original PDF file using this code. Our unique Authentication Codes allow our Printed Records to still incorporate the security and accuracy guarantee from our Digital Signatures.
When our system generates a Record, the PDF file is signed electronically. This digital signature can be viewed and verified by opening the PDF file with Adobe Acrobat, Adobe Reader, or most other PDF viewers. The presence of this electronic signature not only verifies that the file came from us, but that it has not been digitally modified in any way. If the file has been modified in any way, then the signature will no longer appear as valid. The document is jointly signed by TalkingParents (Monitored Communications, LLC) and by Entrust Timestamp Authority™ authenticated by the Adobe Approved Trust List.
All TalkingParents Records, whether in PDF or printed format, include a business records certification. We do our best to cover all bases for various uses and courts across the U.S. and around the world. We cannot provide anyone with legal advice, and we cannot explain the process of submitting a TalkingParents Record as evidence, as we cannot account for the variations in laws and procedures across jurisdictions and from court to court. As such, we must recommend you consult with a qualified local attorney or other appropriate legal resource regarding how exactly to present evidence in court. Yes. If you intend to utilize a TalkingParents Record as evidence in a proceeding, we recommend that you contact opposing counsel and see if a stipulation is possible. Joint stipulations regarding the admissibility of certain documents and other evidence can save a lot of time at the hearing or trial, leaving more time for other important matters.
Maybe. In most jurisdictions, self-authenticating documents are largely limited to public records or other official government documents. Still, there are often exceptions for acknowledged documents when one of our optional affidavits is included, or the presence of our business records certification on all Records may suffice in some circumstances. Consult all applicable evidentiary rules for your court regarding this matter, but remember, the court does not have to find our Record to be self-authenticating for it to be accepted into evidence.
If your client is a TalkingParents user, then laying the foundation for a TalkingParents Record should be as simple and straightforward as with any other form of electronic communication between parties, such as text messages, emails, Facebook messages, etc. You would likely start by handing the Record to your client, asking them what it is and where it came from, and then go from there.
Veracity is not to be confused with authenticity. If the opposing party or counsel challenges the authenticity of the Record, essentially claiming that it isn’t a TalkingParents Record or it has been modified, then they should need to provide some backing to that claim. Our unique 16-digit Authentication Codes and Digital Signatures should be more than adequate to prove authenticity and accuracy. If, instead, they are challenging the veracity of the Record-- usually claiming their client did not write a particular message or take a particular action that is documented on the Record-- then that should be left to the finder of fact once the Record is admitted into evidence.
TalkingParents messages are seldom offered for hearsay purposes. Rather than being offered to prove the truth of the matter asserted in the message, they are often offered to prove that a person did or said a particular thing at a particular time. If the statement from the user is challenged as hearsay, it is likely excluded from hearsay as statement or admission of a party opponent. If not, then there should also be some exceptions available. If the Record is challenged as hearsay in general, or information on the Record like time and date stamps are challenged as hearsay, then a business records exception should always apply.
